While we strive to meet agreed-upon deadlines, delays may occur due to factors beyond our control. Brick & Theme will not be liable for such delays.

6.3 Changes to Scope

Any changes to the agreed-upon scope of work may result in additional charges. Such changes must be documented and approved in writing by both parties.

7. Payments

7.1 Payment Terms

- Payments must be made in accordance with the agreed payment schedule.

- All payments are non-refundable unless expressly stated otherwise.

7.2 Late Payments

Failure to make timely payments may result in suspension of services or additional fees. Brick & Theme reserves the right to recover outstanding amounts through legal means.

Cancellation Policy

Brick & Theme (operated by Pluckwalk Technologies Private Limited) connects customers with service providers ("SPs") in the construction industry, striving to help customers discover and select an SP based on the characteristics that matter most to them. Our goal is to provide transparent and trustworthy construction services, dedicating significant efforts to understanding customer requirements and delivering designs and other essential documents.

In the event a customer decides to cancel a project after paying any portion of the booking amount, the following policy shall apply:

1. Communication of Cancellation

Customers must communicate their intent to cancel clearly and explicitly by:

- Sending an email from the registered email address to support@bricknTheme.com (or any alternate email address provided by Brick & Theme), or

- Sending a registered post with acknowledgement due, specifying the reason(s) for cancellation.

Upon receipt of the cancellation request, Brick & Theme will review it on a case-by-case basis.

2. Cancellation Charges

Cancellations made beyond 48 hours from the payment of the booking amount will incur the following charges:

2.1 Non-Refundable Onboarding Fee

- A fee equal to 1% of the Construction Cost (pre-discount) will be retained as a non-refundable onboarding fee.

2.2 Service Fee Retention

- The applicable service fee will be retained based on the project’s stage, as outlined below:

Any costs borne by the contractor for resource mobilization during the Construction Stage, beyond the 2% stage-wise fee, will be charged on actuals. In case of disputes, Brick & Theme’s decision regarding the charges and/or additional time required shall be final and binding.

2.3 Additional Services

- Charges for services not listed in the schedule above will be billed on actuals.

3. Taxation

All fees mentioned above are inclusive of applicable taxes.

4. Project Commencement

For cancellations after the project has commenced, the refund amount will be calculated based on the terms of the agreement between Brick & Theme and the customer.

5. Documentation and Design Work

- Completed architectural or structural designs, as well as other data collected (e.g., digital surveys, soil tests), will only be shared with the customer as per the fee schedule.

6. Excess Costs

If the costs incurred by Brick & Theme exceed the amounts paid by the customer, the customer shall be liable to pay the difference within **30 business days** of receiving a written notice from Brick & Theme. Failure to pay within the specified timeframe will attract an interest charge of 18% per annum on the outstanding amount until payment is received.

7. Refund Processing

Refunds, if any, will be processed as follows:

- The final refund amount will be determined after deductions and adjustments.

- Refunds will be transferred to the customer’s bank account within 30 business days from the date the final refund value is mutually agreed upon.

- No cash refunds will be issued.

8. Policy Modifications

Brick & Theme reserves the right to modify this cancellation policy at any time without prior notice. The updated policy will be binding on all parties, and the customer’s continued use of our services constitutes acceptance of any changes.
